New York: Ruling declares Daily Fantasy Sports a game of skill

(New York).- After a protracted process stretching seven years, New York state has finally categorically ruled in favour of preserving the status of fantasy sports betting as a legal enterprise. Since 2015, lawmakers and politicians have contested whether engaging in fantasy sports constitutes an act of gambling.
However, in this case, judges determined that comprising a fantasy sports team took substantial skill and knowledge, and therefore could not be perceived as a game of chance.
Given the high-profile nature of the dispute, the issue was settled in the New York Court of Appeals, the most powerful court in the Empire State. The case centred mostly on ‘daily fantasy sports’ the most readily played segment of the fantasy sports suite.
In 2015, New York’s previous Attorney General, Eric Schneiderman, penned a cease-and-desist letter to all fantasy sports operators in the state, demanding them to wind down their respective platforms. However, given that there has never been a formal amendment to legislation, operators maintained their services, and players continued to engaged in fantasy sports pursuits unabated.
The non-profit organization, ‘Stop Predatory Gambling’ has driven efforts to rebuke fantasy sports wagering, sponsoring efforts in the court room and campaigning against its legal legitimacy. Judge Rowan Wilson, disagreed profoundly with his colleagues and therefore submitted a dissenting opinion. He suggested that fantasy sports should undoubtedly be described as a form of gambling, and therefore a constitutional amendment to validate this was required. This would have involved sending the question of legalization to the ballot box.
Fantasy operators such as FanDuel and DraftKings clearly welcomed the news, as a significant period of ambiguity was finally put to bed.
